Tesla is suing this Canadian province for cutting it out of its EV incentives

August 5, 2026 · Electrek · Score: 12

Tesla is suing the Canadian province of Manitoba after being cut out of its electric vehicle rebate program. Manitoba's rebate, launched in 2024, offers up to $4,000 off a new EV under $70,000 and $2,500 off a used one. In its March 2025 budget, the provincial government dropped Tesla and Chinese-made vehicles from eligibility, with officials saying the move was tied to tensions over U.S. tariffs and Elon Musk's support for President Trump. Tesla says this has already cost its Canadian customers at least $560,000 in lost rebates, despite Tesla having been the single biggest recipient of the program before the ban, accounting for more than 20% of all rebates paid out.

Tesla argues the exclusion was unfair and untransparent, noting it was never given a formal explanation and that no other automaker with a U.S. parent company was removed from the program. It's asking the court to reinstate it and pay retroactive rebates to affected buyers. Tesla has won a similar case before: in 2018, a court ruled against Ontario for structuring a rebate wind-down in a way that excluded Tesla.

This case doesn't directly change anything for U.S. homeowners, but it's part of a broader pattern. British Columbia, Nova Scotia, and Prince Edward Island have also excluded Tesla from their EV rebates in 2025 over similar trade tensions, and a Tesla win in Manitoba could set a precedent affecting rebate eligibility rules across other Canadian provinces.
