First Solar drops TOPCon patent complaint

September 17, 2026 · PV Magazine USA · Score: 48

First Solar has dropped a trade complaint it filed with the U.S. International Trade Commission over a solar panel technology called TOPCon (short for Tunnel Oxide Passivated Contact), a type of high-efficiency silicon solar cell used by many of its competitors. The complaint had asked the commission to block imports of TOPCon panels made by rivals including Canadian Solar, JinkoSolar, Trina Solar, and T1 Energy. If granted, that could have cut off a lot of solar panel supply and slowed projects nationwide.

First Solar says it's backing off because of a separate federal action (called Section 232) that already places tariffs and a minimum price on imported polysilicon, the raw material used in most solar panels. The company argues that action now protects domestic manufacturers at the border, so it can shift its fight to U.S. courts instead. First Solar doesn't make TOPCon panels itself — it builds a different kind of panel called thin-film CdTe — but it owns TOPCon patents from a 2013 acquisition, and it's continuing separate lawsuits against those same competitors in federal court.

For homeowners, this is mostly a manufacturers' legal dispute rather than something that changes rebates or installation costs right now. But it's worth watching: if the lawsuits succeed later, some TOPCon panel brands could face import restrictions or price changes, which could eventually affect the cost or availability of solar panels for home installations.
